Qazi Humayun Kabir: An appeal has been filed seeking the suspension of former Chief Justice ABM Khairul Haque's bail in the cases filed in connection with two murders committed during the July uprising.
The state party filed this appeal in the relevant branch of the Appellate Division of the Supreme Court on Wednesday (May 13).
The High Court granted bail to Justice Khairul Haque in two cases on Tuesday. After the order, his lawyers said that there is no legal obstacle to Khairul Haque's release for the time being as he has been granted bail in all the cases. However, the state party has already filed an appeal seeking the suspension of that order.
The Appellate Division upheld Justice Khairul Haque's bail on April 28 in the murder of a Jubo Dal activist during the July uprising, forgery of judgments by the caretaker government, and five cases filed by the ACC.
Earlier, on March 8, the High Court granted bail to Khairul Haque in four cases by granting a rule on bail. Later, on March 11, he was also granted bail in the ACC case. The state appealed to the Appellate Division to suspend this bail. However, the Appellate Division rejected the state's application.
Then, Khairul Haque was shown arrested in the Arif murder case filed at Jatrabari Police Station and Rubel murder case filed at Adabar Police Station. He applied to the High Court after failing to seek bail in these cases in the lower court. He was granted bail from the High Court in both cases on May 12.
Khairul Haque was arrested from his residence in Dhanmondi in the capital on July 24 last year. Later, he was shown arrested in the murder case of Jubo Dal activist Abdul Qayyum Ahad in Jatrabari, Dhaka, during the July Uprising.
